Data Processing Agreement (DPA)

Effective Date: June, 2025

This Data Processing Agreement (“Agreement”) is between Party Plug (“Data Processor”) and users of our platform (“Data Controller”) and forms part of our Terms of Service.

1. Purpose

This Agreement sets out the terms under which Party Plug processes personal data on behalf of users in connection with the use of our platform and services.

2. Definitions

  • Personal Data: Any information relating to an identified or identifiable individual.
  • Processing: Any operation performed on personal data, such as collection, storage, use, or deletion.
  • Data Controller: The person or entity who determines the purposes and means of processing personal data.
  • Data Processor: The person or entity who processes personal data on behalf of the Data Controller.

3. Processing of Personal Data

Party Plug will process personal data only as necessary to provide the services described in our Terms of Service and in accordance with the Data Controller’s instructions. Types of personal data processed may include names, contact details, payment information, and event details.

4. Confidentiality

Party Plug will ensure that all personnel authorized to process personal data are bound by confidentiality obligations.

5. Security

Party Plug will implement appropriate technical and organizational measures to protect personal data against unauthorized access, loss, or destruction.

6. Sub-Processors

Party Plug may engage third-party service providers (“sub-processors”) to assist in providing our services. We will ensure sub-processors are subject to data protection obligations consistent with this Agreement.

7. Data Subject Rights

Party Plug will assist the Data Controller in responding to requests from individuals to exercise their rights under applicable data protection laws (e.g., access, correction, deletion).

8. Data Breach Notification

In the event of a data breach affecting personal data, Party Plug will notify the Data Controller without undue delay and provide relevant information and assistance.

9. Data Retention and Deletion

Upon termination of services or at the Data Controller’s request, Party Plug will delete or return all personal data, unless retention is required by law.

10. Audit and Compliance

Party Plug will make available information necessary to demonstrate compliance with this Agreement and allow for audits by the Data Controller or their representatives.

11. Changes to This Agreement

We may update this Agreement from time to time. We will notify you of any material changes by posting the new Agreement on our website.
